1. Preamble
Ottmar Zimmer, Brettspielnetz makes the BrettspielNetz.de (BSN) service available to all users who are familiar and agree with these General Terms and Conditions (GTC) , the Netiquette and the current Privacy Policy.
2. Service Provision and Disclaimer
BSN gives all users the opportunity to play and communicate with other users. Game operations can take place in the form of individual games or tournaments (tournaments, championships or team games). The users have no legal right to use the service without interruption. There can always be interruptions due to technical or other errors, which will of course be rectified by BSN as quickly as possible. Interruptions do not entitle you to compensation of any kind. Errors in the system can also occur, which lead to individual ratings being falsified or ranks being incorrectly calculated in tournaments. BSN will try to fix such errors in general, but cannot reactivate games or correct tournament procedures. There is no legal right or claim for damages on this either. In general, any claim for damages that may otherwise arise is limited to a maximum of the annual game contribution. This is nothing for users who play for free, but for VIP users it is the proportion of the annual contribution that has not yet been used.
3. Communication
As a user of BSN, you can get in touch with other users in various ways. This can be done publicly (e.g. in the forum) or in private messages (PM) or in game chats. You are responsible for any statements you make. You must therefore adhere to the Netiquette at all times and can be held responsible for violations. BSN reserves the right to remove any or all public content if, in our opinion, it violates the Terms of Service or Netiquette. Consequences for violations can be legal prosecution in the case of criminal offenses, in other cases temporary or complete exclusion from the game (ban). Exclusion from the game operation does not entail any claim for damages, any VIP contributions are forfeited.
Even after deleting your user account, your respective content will remain intact ‐ Public communication (e.g. in the forum) public, private communication with the respective communication partners.
4. Termination
You can request the termination and deletion of your user account at any time using the contact form. However, as long as you offer games yourself or have games running, we cannot comply. So before requesting deletion, you should remove all your game offers and end all running games, for example by giving up. Only then can BSN carry out the deletion.
If you have acquired a VIP rank, it will automatically expire after one year, unless you extend it yourself by transferring the next VIP fee. If you do not renew it, your VIP rank and your VIP privileges will expire, your user account will continue to run as a normal user account. Should you resign as a VIP within the annual term and have your user account deleted, the remainder of the VIP fee will be forfeited in favor of BSN, unless you transfer your VIP account another user.
5. Disclaimer
Liability for Content
The contents of our pages were created with the greatest care. However, we cannot guarantee that the content is correct, complete or up-to-date. As a service provider, we are in accordance with § 7 section 1 TMG for own content on these pages according to the general laws. After §§ 8 to 10 TMG, however, as a service provider, we are not obliged to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity. Obligations to remove or block the use of information according to general laws remain unaffected. However, liability in this regard is only possible from the point in time at which knowledge of a specific infringement of the law is known. As soon as we become aware of any violations of the law, we will remove this content immediately.

6. Governing Law and Jurisdiction
Only German law applies to contracts between BSN (Ottmar Zimmer, Brettspielnetz) and you, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG, “UN Sales Convention”). The place of jurisdiction is Erlangen.
7. General terms and conditions
a) Complaints
Discussions about admins or super admins of Brettspielnetz.de may not be conducted via forums or other public means of communication of Brettspielnetz.de. If you see reason to complain about an admin, contact a superadmin! For other complaints, use the contact form.
b) Cheating, computers, replay opponents, and rating manipulation
On Brettspielnetz.de there is no gambling or betting for money. Games on Brettspielnetz.de are intended for entertainment, for funß and communicating with like-minded people. Nevertheless, Brettspielnetz.de will intervene if there is any manipulation.
c) User Accounts
As a Brettspielnetz.de user, you choose a user name and thus a user account. The user name to be chosen during registration can be chosen freely, but must not have been chosen by another member. Name and trademark rights of third parties must be observed. The selected member name must not violate good morals.
You may not open a second user account and never log in with another user's account. Never give your password to others. You are responsible for all things that happen under your account on Brettspielnetz! Brettspielnetz.de reserves the right to block users if there is a suspicion that they are using multiple user accounts. If you have any suspicion, please report it using the contact form.
d) help, computer, AI
The use of computers to determine moves is strictly prohibited. If such cases occur, the corresponding account can be blocked. In principle, the question arises as to what joy users gain who only win games through cheating. If you have any suspicion, please report it using the contact form.
Even in tournaments and especially in championships, it is forbidden to use aids to determine moves. In such cases, Brettspielnetz.de reserves the right to apply one of the following penalties without warning: Loss of manipulated games, deduction of ratings, blocking of tournaments and championships for an account, temporarily or permanently and in extreme cases immediate blocking of the account.
e) Other manipulations
In the event of other manipulations, Brettspielnetz.de reserves the right to proceed as above. To give examples: 1. Intentional copying of known games, especially in the opening phase and especially in KO rounds of tournaments. 2. Delaying losing games. 3. Blockades that prevent an opponent from winning.
f) Notification procedure and changes to these GTC
These Terms may change over time, but the most current version will always be available on our website. We will notify you of any changes that we deem essential. By continuing to access and use our products after the changes have been posted, you agree to the changed terms. If you do not consent to them, you may no longer use our Services and may request termination.
g) Entire contract/severability clause
These T&Cs, the Privacy Policy and any changes constitute the entire agreement between you and BSN (Ottmar Zimmer, Brettspielnetz) regarding our Services. If any provision of these Terms of Service is found to be invalid, that provision will be limited or voided to the extent necessary, and the remaining provisions of these Terms of Service will continue in full effect .
h) No waiver
No waiver in these Terms will operate as a waiver of principle or continuation of this or any other provision. BSN's (Ottmar Zimmer, Brettspielnetz) failure to exercise any right or provision under the Asserting these Terms will not operate as a waiver of any such right or provision.
